Privacy Policy

A. INTRODUCTION
At Impacto Protective Products Inc. ("IMPACTO"), we take your privacy very seriously. In addition to our established policy of dealing with Personal Information in a sensitive manner, we comply with all legislative enactments to ensure that our collection, use, retention, disclosure and disposal of Personal Information are carried out in accordance with established privacy principles. BY DISCLOSING YOUR PERSONAL INFORMATION TO IMPACTO OR TO ITS AGENTS FOR ANY PURPOSE SET OUT IN THIS PRIVACY POLICY, YOU AGREE THAT IMPACTO MAY COLLECT, USE, RETAIN, DISCLOSE AND DISPOSE OF YOUR PERSONAL INFORMATION IN ACCORDANCE WITH THE TERMS OF THIS PRIVACY POLICY.

This Privacy Policy deals with the following:
  1. our accountability for our privacy practices;
  2. the purposes for which we collect Personal Information and the sorts of Personal Information that we collect across all channels of communication;
  3. the manner in which we obtain consent for our dealings with Personal Information;
  4. the manner in which we use and disclose Personal Information;
  5. our security, retention and disposal processes relating to Personal Information;
  6. your right to access your Personal Information and to request corrections of same;
  7. how you can get answers to questions or raise concerns about our dealings with your Personal Information and/or our compliance with this Privacy Policy; and
  8. our right to amend this Privacy Policy.
B. SCOPE
This Privacy Policy applies to all Personal Information that is held by, or is under the control of, IMPACTO.

C. DEFINITIONS
The following definitions have been created to explain terms that are used extensively in this Privacy Policy:
"Collect" or "Collection" means the act of gathering, acquiring or obtaining Personal Information from you or from third parties, by any means.

"Consent" means your voluntary agreement with what is being done or proposed. Consent can be either express or implied. Express consent is given explicitly, either orally, electronically or in writing. In appropriate circumstances, consent may be implied from an individual's conduct. Consent can also be given by an authorized representative, such as a legal guardian or a person having power of attorney.

"Disclose" or "Disclosure" means providing your Personal Information to anyone other than to you, your authorized agents or to service providers retained by us to process or otherwise deal with Personal Information on our behalf. "Personal Information" means information about an identifiable individual, other than the name, title, business address or business telephone number of an employee of an organization.

"Use" means the treatment and handling of Personal Information.
ARTICLE 1 - ACCOUNTABILITY

1.2 While the Privacy Coordinator is primarily responsible for our Privacy Policy, other IMPACTO personnel may be assigned responsibility for the day to day collection and processing of Personal Information or for acting on behalf of the Privacy Coordinator from time to time.

1.3 We have implemented policies and practices to give effect to our privacy commitment to you, including:
  1. Personal Information security processes (see Article 7 below);
  2. Access, complaint and correction procedures (see Articles 9 and 10 below);
ARTICLE 2 - IDENTIFYING PURPOSES
2.1 IMPACTO does not routinely collect Personal Information in the course of its commercial activities. The Personal Information we may collect can include a customer's credit card, address and other information that is exchanged when an IMPACTO product is purchased. In addition, IMPACTO may collect the names and addresses of individuals who express a desire to be included on IMPACTO's mailing list. This can be done electronically through IMPACTO's website or at trade shows or through other contact. Personal Information is maintained in IMPACTO's integrated manufacturing and accounting software programs.

2.2 Where Personal Information is collected, we explain our purposes for collection at or before the time of collection. If Personal Information that has been previously collected is to be used or disclosed for a purpose not previously identified, we will, subject to our legal rights and obligations, identify that new purpose to you prior to the relevant use or disclosure.

ARTICLE 3 - CONSENT
3.1 Subject to our legal rights and obligations, we will obtain an appropriate form of consent for the collection, uses and disclosures of Personal Information contemplated in Article 2 above.

3.2 You may withdraw your consent to our collection, use or disclosure of your Personal Information at any time, subject to legal or contractual restrictions and reasonable notice. To exercise this right, please contact the Privacy Coordinator in Article 1, above.

ARTICLE 4 - LIMITING COLLECTION
4.1 We will collect only that Personal Information that we require to fulfill the purposes identified in Article 2 above. We collect Personal Information only by fair and lawful means.

4.2 This website collects various types of information from site visitors, including IP addresses, domain name, web page, length of time spent on the website and the pages accessed while visiting the site. This information is collected to among other things, aggregate statistical information, facilitate system administration and improve the contents of the site. This information helps us to improve and respond to visitor enquiries. We will also use and analyze the information we collect so that we can administer, support, improve and develop our business. This website does not use cookies to collect information.

ARTICLE 5 - LIMITING USE, DISCLOSURE AND RETENTION
5.1 Personal Information is used by a limited number of our personnel, on a "need to know" basis, while they are performing their functions. Except as required or permitted by law, we will not disclose your Personal Information without your consent. IMPACTO does not disclose Personal Information to any third parties.

5.2 We retain and dispose of Personal Information in accordance with our Personal Information retention and disposal policies that are in effect from time to time.

5.3 Personal Information that is no longer required in order to meet our identified and legitimate purposes will be destroyed, erased or otherwise made permanently anonymous in accordance with our Personal Information retention and disposal policy.

ARTICLE 6 - ACCURACY
6.1 We will not routinely update Personal Information, unless it is necessary to fulfill the purposes for which the Personal Information was collected. However, we will seek to ensure that Personal Information under our control is sufficiently accurate, complete and up-to-date to minimize the possibility that inaccurate Personal Information may be used.

ARTICLE 7 - SAFEGUARDS
7.1 We protect Personal Information under our control with safeguards that are appropriate to the sensitivity of that information. These safeguards are designed to protect Personal Information in all formats against loss or theft, as well as against unauthorized access, disclosure, copying, use or modification.

ARTICLE 8 - OPENNESS
8.1 Information about our privacy-related policies and procedures is available upon request. This policy is one example of how we deal with Personal Information. If there is a specific question regarding an incidence of the collection, use or disclosure of Personal Information, please contact the Privacy Co-coordinator.

ARTICLE 9 - INDIVIDUAL ACCESS
9.1 Subject to our legal rights and obligations, we will, upon receipt by our Privacy Coordinator of a written request for access, inform you about our possession, use or disclosure of your Personal Information, if any, and permit you to access that Personal Information if it is held or controlled by us. If you request such information or access, you must provide sufficient information with your request to permit us to provide an account of the existence, use and disclosure of that Personal Information. Any Personal Information provided by us to you as a result of a request for access shall be in a generally understandable form.

9.2 We will respond to a request within a reasonable period of time and in any event within thirty (30) days of receipt of the request. We may extend this response deadline for up to an additional thirty (30) days if replying within thirty (30) days would unreasonably interfere with our operations, or if the time required to undertake any consultations necessary to respond to the request would make it impractical to meet that time limit. When necessary, we may also extend the response deadline for as long a period as is necessary to permit conversion of the Personal Information at issue into an alternative format that would allow a person with a sensory disability to read or listen to that Personal Information. We will provide written notice you of any response period extension within thirty (30) days of your request. We will respond to a request for access at minimal or no cost.

9.3 If you demonstrate to our satisfaction that your Personal Information that is held or controlled by us is inaccurate or incomplete, we will make appropriate amendments. These amendments may involve the correction, deletion, or addition of Personal Information. Where appropriate, the amended Personal Information will be transmitted to other parties that have previously received the inaccurate or incomplete Personal Information. Alternately, where your request for an amendment of or addition to your Personal Information is not granted by us, the nature of your request will nonetheless be transmitted to third parties having access to the Personal Information in question.

ARTICLE 10 - COMPLAINTS PROCEDURE
10.1 In the event that you wish to enquire or complain about our Personal Information practices or our compliance with this Privacy Policy, a written enquiry or complaint should be sent to the attention of the Privacy Coordinator at the co-ordinates provided in Article 1 above. The Privacy Coordinator will investigate all complaints and respond to all written enquiries. If a complaint is found to be justified by the Privacy Co-coordinator, we will take all reasonable steps to amend our relevant privacy-related policies or procedures. In addition, you have may a right to complain to Canada's Federal Privacy Commissioner who can be reached Toll Free at 1-800-282-1376.

D. CHANGES TO IMPACTO'S PRIVACY POLICY
We reserve the right to modify or supplement this Privacy Policy from time to time. A revised Privacy Policy will only apply to data collected subsequent to its effective date.
